These Terms of Sale govern every purchase made through brakefreetech.eu. By placing an order you agree to these terms. Please read them before you check out — if something isn't clear, email us at before ordering.
Brake Free Tech EU — a subsidiary with sole proprietorship of BLACKLIST Ventures, registered with the Dutch Chamber of Commerce.
These terms apply to riders purchasing as consumers (natural persons acting outside a trade or profession) and to business buyers. Where Dutch and EU consumer law grants stronger protection to consumers, those rights apply regardless of anything written here. Nothing in these terms limits your statutory rights as a consumer.
To place an order you must be at least the age of majority in your country of residence, or have the consent of a parent or guardian.
Product descriptions, specifications, and images on the site are prepared with care but are indicative. Minor variations in colour, finish, or packaging can occur and do not constitute a defect. We cannot guarantee that your screen's display of colour is exact.
An item shown on the site is an invitation to buy, not a binding offer. A contract of sale is only formed when we confirm your order by email (see Order formation below). We reserve the right to refuse or cancel an order before that confirmation — for example if a product is out of stock, the price or description contains a manifest error, or the order fails fraud screening.
We may limit the quantity of any product sold per person, household, or order, and may refuse orders that appear to be placed by dealers, resellers, or distributors.
Delivery terms, estimated transit times, carriers, and shipping costs are set out in the Shipping Policy, which forms part of these terms. Delivery dates shown at checkout are estimates; they are not binding deadlines unless expressly agreed in writing. Risk of loss passes to the rider on delivery.
If you are a consumer resident in the EU, you have a statutory right to withdraw from the contract within 14 days of delivery without giving any reason, under the EU Consumer Rights Directive (2011/83/EU) as implemented in Dutch law (Art. 6:230o Dutch Civil Code).

Products must conform to the contract at delivery. Under Dutch law (Art. 7:17 Dutch Civil Code) and Directive (EU) 2019/771, consumers have a statutory right to a product that is free of defects and fit for its normal use.
In addition to your statutory rights, Brake Free Tech EU offers a 2-year commercial warranty against manufacturing defects from the date of delivery. Details, coverage, and how to claim are set out in our Help Center warranty article.
The warranty does not cover damage caused by crash impact, water ingress beyond the IP rating, unauthorised modification, or ordinary wear of consumables (adhesive mounts, straps, charging cables).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded under Dutch law, including liability for death or personal injury caused by negligence, for fraud, or under the EU Product Liability Directive.
Subject to that, our total liability for any claim arising out of a contract of sale is limited to the price paid for the product giving rise to the claim. We are not liable for indirect or consequential losses (lost profits, lost revenue, lost savings, loss of data, replacement costs, loss of opportunity) to the extent permitted by law.
Brake Free is a visibility aid designed to supplement the motorcycle's own brake light. It is not a substitute for attentive riding, proper use of the motorcycle's own lighting, or compliance with local road traffic law. Riders remain responsible for safe operation of their motorcycle.
All content on brakefreetech.eu — product designs, images, text, logos, videos, the Brake Free and Brake Free Tech trademarks — is owned by Brake Free Tech EU or its licensors and protected by copyright and trademark law. You may view the content for personal, non-commercial use. Any other use (reproduction, redistribution, commercial exploitation) requires our prior written consent.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to: carrier disruption, customs delay, natural disaster, pandemic, war, strike, or disruption of supply of components. If the event prevents performance for more than 30 days, either party may terminate the contract and we will refund any amount already paid for undelivered goods.

Any comment, review, photo, video, ambassador submission, or other content you send us — whether invited (contest entry, ambassador application) or unsolicited (creative suggestion, product idea) — is provided on the understanding that:
We may, but are not obliged to, monitor, edit, or remove content we consider in our sole discretion to be unlawful, offensive, or in breach of these terms.
You agree to indemnify and hold harmless Brake Free Tech EU, its parent, affiliates, officers, directors, employees, agents, contractors, and suppliers against any claim, demand, or reasonable legal costs made by a third party arising out of:
This clause does not apply to the extent Dutch law prohibits indemnification between a business and a consumer.
These terms are effective until terminated by either you or us. You may terminate at any time by ceasing to use the site. We may terminate or suspend your access immediately, without notice, if we reasonably believe you have breached these terms. Obligations that arose before termination — including payment obligations and liability for loss caused by a prior breach — survive termination.
We take complaints seriously. Email with subject line COMPLAINT and your order number. We acknowledge complaints within 1–2 business days and aim to resolve them within 14 days.
If we cannot resolve a dispute directly, EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not contractually bound to submit to any specific alternative dispute resolution body, but will engage constructively where appropriate.
These terms and any contract of sale formed under them are governed by Dutch law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Disputes are subject to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, save that consumers retain the right to bring proceedings in the courts of their country of residence under mandatory EU consumer protection rules.
If any provision of these terms is held to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will continue in force.
Our failure to exercise or enforce any right under these terms is not a waiver of that right.
These terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any other policy incorporated by reference, constitute the entire agreement between you and Brake Free Tech EU in respect of your use of the site and your purchases, and supersede any prior agreement, communication, or proposal on the same subject matter.
We may update these terms from time to time. The version in force at the moment you place an order is the version that governs your purchase. The "Last updated" date at the top reflects the current version; material changes will be communicated by email to account holders and newsletter subscribers.
